1. Introduction
These Terms and Conditions (“Terms”) govern your use of www.trogir.tours and the tours, day trips and boat rentals provided by Ćuvita, obrt za usluge, trading as Trogir.Tours (“we”, “us”, “our”). Personal identification number (OIB): 77915022768.
By making an enquiry or a booking with us, you confirm that you have read, understood and agree to these Terms. Please read them carefully.
2. Our services
We offer guided boat tours, speedboat excursions, land day trips and private boat rentals departing from Trogir and the surrounding area (Okrug, Split and Kaštela). Tour descriptions, itineraries, inclusions and prices are published on our website and are correct at the time of publication.
Itineraries may be adjusted by our crew or skipper where necessary for safety, weather, sea conditions or operational reasons. We will always aim to deliver an equivalent experience.
3. Bookings
You can request a booking through our website, by email or by phone. A booking request is an offer by you; a binding contract is formed only when we confirm your booking in writing (by email).
You are responsible for providing accurate and complete information, including the correct number of guests, ages where relevant, contact details and any special requirements. Please check your confirmation carefully and tell us promptly if anything is incorrect.
4. Prices and payment
All prices are shown in euros (EUR). Tour prices are per person unless stated otherwise; boat rental prices are per day. The inclusions and exclusions for each tour or boat are listed on its page.
Unless otherwise agreed, the balance is payable as set out in your booking confirmation. For boat rentals, a refundable security deposit is required on collection and is returned in full provided the boat is returned on time, with the same fuel level and without damage.
We reserve the right to correct obvious pricing errors before your booking is confirmed.
5. Cancellations and changes by you
You may cancel your booking by contacting us as early as possible. Our standard cancellation terms are:
- Full-day boat tours and day trips: free cancellation up to 48 hours before departure.
- Half-day tours: free cancellation up to 24 hours before departure.
- Cancellations made later than the periods above, or failure to appear at the meeting point at the scheduled time (“no-show”), may not be refundable.
The specific cancellation window for your booking is shown on the relevant tour page and in your confirmation. If you need to change the date or number of guests, contact us and we will do our best to accommodate you, subject to availability.
6. Cancellations and changes by us
Your safety comes first. We may cancel, shorten, delay or re-route a tour because of weather, sea conditions, technical issues, insufficient bookings or other circumstances beyond our reasonable control.
If we cancel a tour before departure and cannot offer a suitable alternative date, you will receive a full refund of the amount paid to us. We are not liable for any additional costs you may incur, such as travel, accommodation or other arrangements.
7. Boat rentals — additional terms
For bareboat (self-drive) rentals, the following additional terms apply:
- a valid boat licence and VHF certificate are required for the person operating the boat, as indicated on the boat page;
- a refundable security deposit is payable on collection;
- fuel is not included unless stated; the boat must be returned with the same fuel level;
- minimum skipper age requirements apply as stated on each boat page;
- you are responsible for the boat and equipment during the rental period and for any loss or damage caused other than by fair wear and tear;
- a professional skipper can be arranged on request for an additional fee.
8. Your responsibilities and conduct
To keep everyone safe and the day enjoyable, you agree to:
- arrive at the meeting point at the agreed time (we recommend 15 minutes early);
- follow the reasonable instructions of the captain, skipper or guide at all times;
- behave responsibly and with consideration for other guests, our crew and the marine environment;
- supervise children in your party at all times;
- not board if you are excessively under the influence of alcohol or drugs.
We reserve the right to refuse boarding or to end participation, without refund, where a guest’s behaviour endangers safety or seriously affects the experience of others.
9. Health, safety and suitability
Please tell us at the time of booking about any medical condition, reduced mobility, pregnancy, or other circumstance that may affect participation. Some tours involve swimming, sun exposure and time at sea, and may not be suitable for everyone.
You take part in activities such as swimming and snorkelling at your own risk and should only do so within your ability. Life jackets and safety equipment are provided on board.
10. Liability
We provide our services with reasonable skill and care and in accordance with applicable Croatian law. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, or for loss or damage to personal belongings brought on board.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.
11. Insurance
We hold the insurance required to operate our tours and rentals. This does not cover your personal belongings, medical expenses or trip cancellation, and we strongly recommend that you arrange your own travel insurance.
12. Photography
We may occasionally take photographs or videos during tours for promotional purposes. If you do not wish to appear in such material, simply let our crew know and we will respect your request.
13. Intellectual property
All content on this website — including text, images, logos and design — is owned by or licensed to Trogir.Tours and is protected by intellectual property laws. You may not reproduce or reuse it without our written permission.
14. Force majeure
We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including extreme weather, natural disasters, strikes, government restrictions or other force majeure events.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Croatia. Any dispute arising from them shall be subject to the jurisdiction of the competent court in Croatia. Consumers may also have access to out-of-court dispute resolution and the EU Online Dispute Resolution platform.
16. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the time of your booking is the version that applies to that booking.
